Medical clinic litigation nets Kincardine half-a-million dollars

Kincardine council has ratified a settlement between the municipality and the individuals and companies contracted to do the design and construction of the Kincardine Community Medical Clinic parking lot and helipad in 2003, resulting in a payment of $515,000 to the municipality.

Due to the flawed design and construction, water seeped into the basement, causing a persistent mould problem which resulted in added expense to the municipality to add proper drainage to the building.

The legal action was launched in 2007, said chief administrative officer John deRosenroll. An integral part of the legal system is to be involved in a mediation process that allows each of the parties an opportunity to settle the dispute well before trial preparation.

At a closed session of council Tuesday night (Aug. 24), the municipality received legal advice with respect to the mediator's report, resulting in an open session motion, bringing the litigation process to an end.

Council agreed to ratify the settlement and take the $515,000, believing this is in the best interest of the municipality.

The grand opening of Phase 2 of the medical clinic is scheduled for early October, welcoming back McKechnie Pharmacy and all the medical clinic staff and doctors.
