Patti Richards is surprised that cottagers at Poplar Beach are staying through another summer, following last year's decision by Huron-Kinloss council, ordering the cottages vacated and removed. The seven cottages are located on the west side of Boiler Beach Road, between the 10th and 12th concessions in Huron-Kinloss. Council had stated in 2008, that the tenants had to vacate by September, 2010, due to environmental and liability issues. The matter went to litigation but was decided in December, 2010, by an order of the Landlord and Tenant Board. Richards, who lives near the cottages, sent a letter to council which was discussed at the meeting last night (June 20). In her letter, Richards states that one of the cottages has been rented and lived in on a daily basis since mid-March, if not before. "Now that we are into cottage season, we are seeing regular traffic and residence at most of the cottages, if not all," writes Richards. "Last weekend, there were at least four vehicles at one cottage for the weekend. The sewer smell when I ran in the morning while they were there, was extremely strong - perhaps the septics are being challenged by the high water table and high lake after all of the rain we have seen." She states that one of the cottages is currently "for rent" by MEG - Gibson Realty. She requested the municipality send her a copy of the documentation, showing that the cottagers have complete use of these properties until Sept. 25, 2011 - basically allowing them a one-year extension before they must vacate. Clerk Sonya Watson received council approval to send Richards a letter including a copy of the resolution regarding the Poplar Beach cottages. In December, 2010, the Landlord and Tenant Board ordered the following: • The tenants shall be required to provide vacant possession of the cottages
to the township on or before Sept. 25, 2011. This date is final, not extendable
and may be enforced without further legal or process requirements;

• The tenants will have until Sept. 25, 2011, to remove the cottages or
portions thereof. As of Sept. 26, 2011, all right, title and interest in the
cottages shall reside with the township;
• This is a full and final settlement of the matter. The tenants have agreed not to appeal or pursue any issues relating to the cottages in court or any other forum, including by way of representations to Huron-Kinloss council. This resolution, which has been incorporated into an Order of the Landlord and Tenant Board, brings to an end a long-outstanding matter and precludes the need for further legal process. The township believes that it is fair and responsive to the tenants while recognizing that the cottage properties are public properties that belong to the residents of Huron-Kinloss. Richards also registered a formal noise complaint regarding fireworks being set off every weekend and after 11 p.m., sometimes much later than that.
